According to statistics of the Ministry of Overseas Indian Affairs, around 30 million NRIs have inhabited and settled in almost 200 countries across the globe in which 3 millions are in UAE, where the highest population of Indians among them 50% is Malayalees.

In the fast-changing scenario of technology and development, it remains to be seen that majority of NRIs were ignorant about the new laws. Thus, we have to first make a report card to evaluate the opportunity to understand foreign country laws from their home country before going aboard. Undoubtedly, international Indians are an entity by themselves. Thus there is a dire need for a global law to govern their conflicts mainly related to immigration, nationality, child custody, inter – country adoptions, succession and inheritance, tenancy of Indian Property, , inter country contracts for business investments etc.

The applicability of foreign laws, the validity of judgments pronounced overseas and the verdicts of Indian courts which need expounding, are issues that require interpretation by International Legal practitioners. Personal laws governing global Indians searching for relief measures face multiple jurisdictional clashes and are unable to reconcile their rights with corresponding obligations in Indian laws. International law firms attempts to provide comprehensive answers to these problems.

There are wide ranges of issues that cause disputes between NRIs across borders.

The only way this can be resolved is by availing the service of International law firms in India. But in the present situation, Government of India not permitted the Foreign Lawyers to practice at Indian Courts and International Law firms can’t open their office in India. In this Scenario, an Indian Lawyer who had the license to practice at International Courts and domestic Courts can only open an International Law firm in India.

Human rights and the criminal justice system need international application in Indian laws. Our judiciary has to meet the needs and demands of international Indians. For example, innocent children are made victims of spousal fights across borders and are used to settle personal disputes. Likewise in commercial, human smuggling and illegal immigration, International adoption of children etc needs the support of International Lawyers.

Indian laws can no longer exist in isolation; they must be reconciled with laws abroad. At the same time to avail legal rights in their home country is daunting. The foreigners who were visiting India also facing same problem without an International Law firm in India.

For the above said purpose, Adv. Benoy Sasi, a member of Kerala High Court Advocates’ Association, India International ADR Association and International Bar Association opened an International Law Firm at Cochin. He is also the Legal Counselor at Indian Workers Resource Centre (IWRC) under Indian Embassy, UAE.
